User Agreement for the iOS App “Kaufbei.de – Online Marketplace”

2. Scope of Application

This agreement governs the use of the iOS app “Kaufbei.de – Online Marketplace” by consumers located in Germany and the European Union.

3. Relationship with Apple

This app is distributed via the Apple App Store.
Apple Inc. is not a party to this user agreement and is not responsible for the app’s content, technical operation, or customer support.
All contractual relationships exist solely between the user and Kaufbei GmbH.

4. App Features

The app allows users to:

Browse products
Purchase products
List their own products for sale
Exchange messages with other users
Leave reviews

5. Registration

Certain features, such as selling products or messaging, require registration.
Users must be at least 18 years old and provide accurate information.

6. Purchases and Contracts

When a purchase is made, the sales contract is concluded directly between buyer and seller (merchant or private individual).
Kaufbei GmbH provides the platform but is not a contractual party to these transactions.

7. Payments

Payments are processed via PayPal or Stripe under their respective terms and conditions.
Apple is not involved in any payment processing.

8. In-App Features and Notifications

The app may send push notifications (e.g., for orders or messages).
Users can disable notifications in their iOS device settings.
The app does not offer Apple in-app purchases.

9. Reviews and User Content

Users may post reviews and content, provided these do not violate applicable laws or third-party rights.
Kaufbei GmbH reserves the right to remove any unlawful or inappropriate content.

10. License to Use

Kaufbei GmbH grants users a non-exclusive, non-transferable, revocable license to install and use the app on iOS devices.
Reverse engineering, copying, or redistribution is prohibited.

11. Liability

Kaufbei GmbH is liable only for intent or gross negligence.
No liability is assumed for damages caused by other users or sellers.
Apple assumes no liability for the app’s performance or support.

12. Data Protection

Personal data is processed in accordance with the Privacy Policy.

13. Termination

Users may terminate this agreement at any time by deleting their account or uninstalling the app.
Kaufbei GmbH may suspend or delete accounts that violate these terms.

14. Changes to this Agreement

Kaufbei GmbH may update these terms to reflect legal, technical, or operational changes.
Users will be notified of material updates within the app.

15. Applicable Law

This agreement is governed by the laws of the Federal Republic of Germany.
Mandatory consumer protection laws of the user’s country of residence remain unaffected.

16. Dispute Resolution

Kaufbei GmbH is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
